Bo Bice, 29, the Southern rocker from Helena, Ala., was arrested in 2001 for felony cocaine possession and was busted again for marijuana possession in 2003, but the charges were dismissed after he completed a diversion program, the Smoking Gun Web site reports. Bice was first busted in June 2001 by Huntsville, Ala., cops, according to a warrant posted on the site. But when a Huntsville police investigator didn't show up for Bice's preliminary hearing on August 29, 2001, Judge Susan Moquin dismissed the case, according to a court docket. After prosecutors prepared to re-file the felony count, Bice opted to enter a drug diversion program. But he didn't complete the program until after he was busted again -- this time in 2003 on charges of marijuana possession, public intoxication and possession of drug paraphernalia, according to court records obtained by the Smoking Gun. All of the charges were dismissed last year. More on this story All the latest Idol news No immediate word from FOX on whether producers already knew about the arrests. But Bice is only the latest of several Idol contestant to have a rap sheet. Current finalist Scott Savol was arrested in 2001 on a charge of felony domestic violence after allegedly roughing up his infant son's mother. Idol's 2004 finalist Donnie Williams was arrested on suspicion of DUI; Frenchie Davis, on the show in 2003, was discovered to have posed on an adult Web site; and finalist Corey Clark and semifinalist Jaered Andrews both had previous arrest records.

you know if they do not kick him off there will probally be law suits coming, from all the ones that were kicked off because of there records.... dont you think??

It depends on whether or not he divulged this information beforehand. I think that if they keep their secrets and they come out during the show, then there's a problem. But if the producers know about their problems beforehand and still allow them to continue, they have no recourse if the Smoking Gun or whoever else digs up the info.

I still don't understand the rationale behind revealing and not revealing. The "crime" is what matters to me. Just because someone reveals it...doesn't make it ok. I don't understand what FOX is trying to accomplish.

The people that have been kicked off did not reveal their past to the producers. Personally, I think someone that reveals they've had drug charges shouldnt even be given the chance, but whatever.

I kind of agree with what you're saying elleinad, but I still think if Scott remains than Bo has every right to as well. I mean these people are suposed to be idols and there is a (former) druggie and a (former) woman abuser (we can hope). I remember some people getting their panties in a knot about Fantasia because she had a child out of wedlock when she was young and didn't graduate highschool, but I mean, those are NOT crimes!

FOX should adapt a rule for next season that anyone with a criminal past is not eligible to apply for the show. And if it turns out you have one, you get booted from the show immediately.

There is a difference. The people that have been kicked off did not reveal their past to the producers. Not true -- I can't think of her name, but the chick who did the adult web site disclosed it to them before the show and she was still booted.
